The Wine House

In California, the laws regarding private schools are in flux, and are expected to be tightened very soon. The regulations cited below may no longer be in effect, but stricter ones are expected to be enacted.

The Wine House is functioning as Private Postsecondary Educational Institution, as defined under 94739 of the Private Postsecondary and Vocational Education Reform Act. The Wine House is not registered as a school in California, and is not exempt from this law because they claim to offer professional training for the food & wine Industries. They are also in gross violation of subsections of 94831, because they are operating in “in this state a postsecondary educational institution not exempted from this chapter” without a permit. Under the law, the WSET certification could be considered a “false or misleading educational credentials.” as stated in 94705 (c).

The Wine House is at risk of criminal sanctions put forth under section 94834 (a) by offering the WSET programs. If found to be in violation, the owners of Wine House could be fined up to $50,000 and imprisoned for up to one year in a state prison.
