Fraudulent Profesional Certification Since 1994
Companies running the WSET program are in violation of state laws by offering professional training without proper authorization.
The companies listed below claim to offer “Professional Certification” for the food & wine industry. This violates section 500, “No private school or computer training facility which charges tuition or fees for instruction and which is not exempted hereunder shall be operated by any person or persons, firm, corporation, or private organization for the purpose of teaching or giving instruction in any subject or subjects, unless it is licensed or registered by the department..” None of these companies are registered all charge tuition and are not registered with the State Education Department of New York.
Furthermore, these companies are not exempt from licesnsing since they do not meet the prerequisites for exemptions under subsection (c). The companies offers publicly available training programs to normal adults who are looking to work in a field that does not require professional licensure or specialized training.
Under section 5003.6, the department commisioner is authorized to fine each school up to $50,000 for “operation of a school without a license” and is also permitted to permanently shut down the school. The commisioner can also order restitution to students who attended these WSET programs.
These companies are acting as schools and offering professional WSET certificates without a license to do so in New York. By law, they must be shut down.
